EPB News Center How to Prevent Solar Scams ATTORNEY COSTES ATTORNEY GENERAL RUSSELL COLEMAN HOW TO PREVENT SOLAR SCAMS READ THE CONTRACT: Do not sign an agreement to purchase a solar power systemwithout reading the contract. Pay special attention to see if the terms of the contract contradict information that a solar sales representative provided to you verbally. For example, a solar sales representative verbally tells you that a proposed system is "guaranteed" to reduce your monthly electric bill by "70-80%," but the contract states that the solar company cannot guarantee the amount of electricity that a system will produce or your expected savings, e.g., a clause stating that "[Solar Company] disclaims all warranties (oral or written) with respect to production, usage, and savings." If you find significant discrepancies between what the solar sales representative told you and what the solar company's contract states, you should seriously consider whether you want to enter into a major financial transaction with the company. Do not let a sales representative pressure you into signing a solar contract without reading it. A solar company is asking you to agree to make a major financial commitment by purchasing a solar power system. The sales representative can wait for you to read the contract. Get Competing Bids From Multiple Solar Companies: Solar power systems can be costly, and like any major home improvement project, you should obtain bids from multiple companies. Be wary of any company that tries to pressure you into making an on the spot purchase decision. Remember, incentives like "same-day signing bonuses" or "deal of the day" are often intended to induce customers into making a purchase decision before they have fully explored their options and obtained competing bids. Even though a bonus or rebate for purchasing a solar power system the same day you meet with a company's sales representative may seem like a good deal, agreeing to purchase a solar power system from a company before fully exploring your options and obtaining competing bids could result in you paying significantly more for a solar power system because the particular company you met with charges a substantially higher price overall than its competitors. Avoid High Pressure Sales Tactics: Be wary of high pressure sales tactics. A reputable company should respect your desire to do independent research and take some time to think about its proposal before making the major financial commitment of purchasing a solar power system. Obtaining the required information from potential customers is a precautionary measure of protection to prevent any unauthorized access to customer accounts, as well as the prevention of identity theft. This policy will be applied without regard of race, color, creed, sex, national origin, or marital status. Security Deposit: Applicants for telecom services will be charged a security deposit based on the EPB’s Telecom Deposit Policy. Connection Fees: The Electric Plant Board may charge a connection fee to cover the cost of turning on service. Company Policies Miscellaneous Fee Schedule - Telecommunications Previous Next Installation Fee $ 49.95 Charged to install and activate service at customer premise. Also includes relocating previously installed service and the addition of new services and equipment. Reconnect Fee – Monthly Billing $ 35.00 EPB employees perform work to reconnect a service that has been disconnected for nonpayment during normal working hours of 7:30 AM – 4:00 PM on an EPB scheduled work day. After-Hours Fee $ 49.95 Charged to the customer if the service technician is called to a customer location after 4:00 PM and/or before 7:30 AM, weekends, or on holidays observed by EPB, and the issue is not related to SmartNet equipment malfunctions or EPB services, but due to a customer issue. Disconnect Fee $ 35.00 Charged if service is disconnected due to nonpayment and customer leaves the EPB service areas without having service reconnected. Other Collection Fees $ COST Any cost incurred by the EPB to collect an unpaid balance, including attorney fees, collection agency fees, court cost, filing fees, etc. Returned Check Charge $ 25.00 Any payment, including electronic payment, accepted by the EPB for a Customer’s account that is returned by the financial institution for any reason. Engineering Staking Fee $ 100.00 To state or engineer a new construction or a change in service. The fee will be deducted from project invoice at completion of project. Equipment Fee $Variable Charged if a customer’s service is disconnected for any reason and equipment is not returned. Company Policies Disputed Bill Policy Previous Next Purpose: Russellville EPB’s Disputed Bill Resolution Policy is to provide all customers with a fair and consistent process for resolving billing disputes through the established chain of command beginning with EPB’s Customer Service Representative (CSR). The Disputed Bill Resolution Policy will be applied without regard of race, color, creed, sex, national origin, or marital status. Resolution Procedures: A customer who believes their monthly bill is in error shall notify the EPB office by phone, mail, email, or in person prior to the “Past Due After” date on the monthly bill. Payment of the disputed portion of the bill will be postponed until the dispute has been resolved. A customer waiting to dispute a bill until the EPB has scheduled service to be cut off due to non-payment must pay the bill in full and then begin the resolution process. Inability to pay a bill when due is not a basis for a disputed bill. An EPB Customer Service Representative (CSR) will investigate the disputed bill and notify the customer of their findings. If the CSR is unable to resolve the error/dispute the customer may request that the Customer Service Manger review the bill and make a decision as to the dispute. In the event the customer is not satisfied with the decision of the Customer Service Manger, the customer may request an appointment with the General Manager to review the disputed bill. At the review the customer shall present any evidence to support why the bill is in dispute and the General Manager or his/her representative shall present what efforts the EPB has taken to resolve the dispute or support the correctness of the amount due. The General Manager will make a decision within three (3) business days and notify the customer in writing of the decision. In the event it is deemed the customer owes the disputed bill, in whole or in part, the decision will specify a date, not to exceed seven days from the date of the decision, that the disputed bill, or portion there of, must be paid to avoid additional collection procedures. In the event the customer remains unsatisfied with the General Manager’s decision the customer may request a hearing before the Board of Directors of the EPB at one of its regular monthly meetings. Such requests shall be in writing and delivered to the General Manager and/or the Secretary to the Board who will schedule the Board hearing at the earliest practical date. Decisions by the Board are final and shall be conveyed to the customer in writing. The customer has the right to have other representation at any of the hearings. Company Policies Deposit Policy - Residential Electric Previous Next Purpose The purpose of this Deposit Policy is to outline the guidelines and procedures for accepting and processing deposits to ensure consistency, security, and compliance with applicable rules and regulations. This policy aims to protect both the institution and its customers by establishing clear expectations for deposit required to establish electric service with the EPB. By setting forth these standards, the policy seeks to promote transparency, reduce risks associated with deposit handling, and maintain trust in the financial operations of the organization. General Guidelines 1. EPB’s Deposit policy will be applied without regard of race, color, creed, sex, national origin, or marital status. 2. Deposits may or may not transfer from one location to another. 3. Upon termination of service, deposits will be applied against any unpaid balance or charges for non-returned or damaged equipment. 4. Any remaining amount will be returned to customer, either by check or by applying the balance of the deposit to any active account of the customer. Security Deposit - New Customers Applicants will be charged a deposit equal to approximately one (1) month’s charges for the services requested (rounded up to the next $10.00). Additional Security Deposit - Existing customers An existing customer of the EPB who does not have a deposit, or who has a deposit less than the maximum deposit may be required to pay an additional deposit in the event of any of the following: 1. Has an EPB system rating of “NORMAL,” “POOR,” or “VERY POOR” 2. EPB has initiated steps to discontinue service due to non-payment 3. Has had a payment (check or automatic draft) rejected by the financial institution due to, but not limited to, a closed account or insufficient funds. Additional deposits may be required until such time as the total deposit, excluding accrued interest, approximately equals twice the highest monthly bill for service of customer at his/her current location over the most recent twelve-month period. Interest on Deposit All cash deposits greater than one month’s average bill and retained longer than twelve months shall accrue interest at the current rate authorized by the Board, which shall not be less than the interest earned on LPC’s primary bank account. Interest will be calculated using a simple interest rate and will not be compounded. Interest will accrue annually on a deposit and will be paid when the deposit is refunded or applied to the customer’s account. Company Policies Tree Trimming Policy - Electric/Telecommunications Previous Next PURPOSE: The purpose of the Russellville EPB Tree Trimming Policy is to support preventative maintenance efforts by establishing vegetation management practices that reduce risk to utility infrastructure and improve service reliability. This policy will be applied without regard of race, color, creed, sex, national origin, or marital status. TRIMMING PRACTICE: Where a tree is located beside a primary line, the EPB will trim only that portion of the tree that creates the potential for interruption of service to the customers of the EPB. This practice is commonly referred to as "side trimming". The trim will be made to a minimum of ten (10) feet from the primary line or the main trunk of the tree, whichever is closer to the line. Where the tree is located directly below the primary line, the EPB will trim only the portion of the tree that creates the potential for interruption of service. This trimming is normally referred to as "V trimming". The trim will be made as low as possible and at a width that will provide ten-foot (10) clearance on either side of the primary line. If the tree owner wishes to have the entire tree trimmed, referred to as "rounded over", it will be the owner’s responsibility either prior to or after the EPB’s trimming has occurred. TREE REMOVAL PRACTICE: Where a tree is located under or near a primary line (problem tree) and the tree owner agrees in writing, the EPB will have the tree removed, provided the owner agrees NOT to have or allow another tree to be planted under or near the line that will grow to a height that will create the possibility of having to trim the new tree in the future. This does not prevent the owner from setting low growing trees to replace the tree removed. To encourage the removal of problem trees the EPB agrees to provide replacement trees under its Trade a Tree Program. If the owner prefers, the EPB will have the stump of the removed tree "ground" and NOT replace the tree. SECONDARY & SERVICE DROPS: Secondary Insulated wire from the transformer to a service pole that serves more than one location is known as a "secondary line". Where the secondary line is located over public right-of-way, the EPB will apply the same trimming and removal practices as to that of primary lines. Where secondary lines are located over private property, EPB management will coordinate with the property owner as to the best solution to address the problem trees. Service Drops Wires from the transformer, or a service pole, to the customer’s point of attachment is known as a service drop. Service drops run over private property and problem trees located on that property would be the total responsibility of the property owner. If the property owner wishes to trim or remove a problem tree, EPB personnel will take down the service drop until work is completed. This policy is intended to be used as a guide uniform to all customers of the EPB. However, the EPB reserves the right to make allowances for extenuating circumstances which have been reviewed and determined by management, and to take action that will be in the best interest of the EPB and its customers. Company Policies Primary Line Extension Policy Previous Next PURPOSE: The purpose of this policy is to provide clear and consistent guidelines governing the extension, relocation, and upgrade of primary electric lines, and to define the respective responsibilities of the Russellville Electric Plant Board and its customers. This policy will be applied without regard of race, color, creed, sex, national origin, or marital status. RESIDENTIAL: SINGLE FAMILY DWELLING Overhead: Upon customer request for electric service to a new residence, the Russellville EPB will construct the lines it deems appropriate for the electric load to be served. When the distance from the EPB’s existing primary line to the new residence requires the extension of its primary lines, the EPB will, at its own expense, extend its primary lines up to a distance not to exceed two hundred (200) feet. If the distance is in excess of two hundred (200) feet, the EPB will construct the line and prorate the cost, including but not limited to labor, material, equipment, and overhead by dividing the total cost by the distance of the primary extension. The customer will bear the prorated cost of the distance which exceeds two hundred (200) feet. Fifty percent (50%) of the established cost must be paid prior to construction beginning, with final cost reconciliation conducted upon completion of the work, and the remaining balance paid prior to electric service being connected to the residence. When such extension is necessary, the customer shall bear the cost of providing an easement of right-of-way, acceptable to the EPB, to cross or construct on any land where the EPB does not have the right of public right-of-way. Underground: When a customer requests that the EPB’s primary line extension be placed underground, the customer will be responsible for and bear the cost of opening a ditch from a pole designated by the EPB to a point to be determined by the EPB and customer for a pole or transformer pad. Said ditch must meet the minimum specifications determined by the EPB based on the use of the area over the buried line. Customer, at its cost, shall install conduit (minimum of 2 1⁄2” schedule 80) the distance of the ditch, using large radius 90 degree elbows at base of poles, transformer pads and all other areas requiring elbows, along with a pull string strong enough for the EPB to pull its pulling rope the distance of the conduit. The EPB will install the primary line in the conduit from the pole to the pole or transformer pad. Customer will be responsible for 100% of cost, including but not limited to labor, material, equipment, and overhead. Fifty percent (50%) of the established cost must be paid prior to construction beginning, with final cost reconciliation conducted upon completion of the work, and the remaining balance paid prior to electric service being connected to the residence. When such extension is necessary, customer shall bear the cost of providing an easement of right-of-way, acceptable to the EPB, to cross or construct on any land where the EPB does not have the right of public right-of-way. In the event the customer cancels the request for electric service after the EPB has incurred expense to extend its primary line, the customer shall be liable for all costs incurred by the EPB to extend its primary line at the time notice is given. Three Phase Service: Residential customers requesting three phase service will be responsible for all costs above that of a normal single phase line extension and service installation including but not limited to labor, material, equipment and overhead. RESIDENTIAL: SUBDIVISION Overhead: The EPB will only construct primary lines into a subdivision that has been properly approved by all required local, state, and federal bodies having jurisdiction over such developments, and after a plat of the approved subdivision has been recorded with the office of the Logan County Court Clerk. Such recorded plat must provide for a dedicated easement of right-of-way for utilities a minimum of twenty (20) feet wide of which ten (10) feet may be a part of the public right-of-way for a road or street. The developer of the subdivision will reimburse the EPB for all costs, including but not limited to labor, material, equipment, and overhead, incurred to extend primary to the subdivision. Fifty percent (50%) of the established cost must be paid prior to construction beginning, with the final cost reconciliation conducted upon completion of the work, and the remaining balance being paid prior to electric service being connected to the residence. The EPB’s cost will be prorated by the number of lots included in the subdivision plat and the EPB will refund to the developer the prorated cost of one lot for each residence constructed. Any prorated refund shall only be due upon proof that the specified lot has been conveyed by deed to a subsequent owner. Refunds will be issued only to the developer and not to a subsequent owner or individual lot owner. Rental properties are not eligible for prorated refunds. Any prorated refund shall not exceed the amount invoiced upon completion of the project. In the event developer sales adjoining lots to one individual and only one residence is constructed, the developer will receive a refund for the prorated cost of the individually deeded lot. Fifty percent (50%) of the established cost must be paid prior to construction beginning, with final cost reconciliation conducted upon completion of the work, and the remaining balance paid prior to electric service being connected to the customer location. In the event the customer cancels the request for relocation after the EPB has incurred expense to relocate line, customer will be liable for all costs incurred by the EPB at the time notice is given. Upgrade: In the event there is a request to upgrade service to a location, customer will be responsible for 100% of cost including, but not limited to labor, material, equipment, and overhead. Fifty percent (50%) of the established cost must be paid prior to construction beginning, with final cost reconciliation conducted upon completion of the work, and the remaining balance paid prior to electric service being connected to the customer location. Upgrade may consist of increasing primary line wire size, service wire size, or transformer capacity. In the event the customer cancels the request for the upgrade after the EPB has incurred expense, the customer shall be liable for all costs incurred by the EPB at the time notice is given.
